Privacy Policy

Brightcore Residential, Inc., a Delaware corporation, which does business as BFranklin and its authorized agents (referred to as “BFranklin”, “us”, “we”, or “our” as the context may require), respect your preferences concerning the treatment of Personal Information we may collect. “Personal Information” is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Personal Information may include, but is not limited to, your name, physical address, telephone number, e-mail address, company affiliation and associated interests.

This Privacy Policy (“Policy”) lets you know how we collect and use your Personal Information, and describes our practices regarding information collected from the BFranklin applications that link or refer to this Policy (such as our websites, computer software applications, subscription services, social media pages and HTML-formatted e-mail messages), as well as through offline sales and marketing activities (collectively, the “Channels”).

The Channels may provide links to or the ability to connect with non-BFRANKLIN websites, services, social networks or applications. Clicking on those links or enabling those connections may allow the third party to collect or share information about you. Those third-party websites or services are beyond our control. We encourage you to check the privacy policies and terms of use of any non-BFRANKLIN websites or services before providing your Personal Information to them.

Personal and Other Information We Collect

BFRANKLIN collects Personal Information provided to us through your interaction with and use of the Channels. We collect any information that you voluntarily give us through your interaction with and use of the Channels, including:

(1)          Forms you fill out on our websites;

(2)          Content of your electronic correspondence with us;

(3)          Disclosures made by you during offline sales and marketing activities;

(4)          Reporting a problem or requesting support for any of our products and services; and

(5)          Any other information you voluntarily send to us.

We also collect certain types of technical information about your interaction with and use of the Channels to maintain, support and improve our websites, products and other services, including:

(1)          Technical information, including IP address, login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;

(2)          Information about your visit, including the full URL clickstream to, through and from our site (including date and time); and

(3)          Pages you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

We may receive information about you from third parties who we partner with in order to build and operate our communities, including, for example, business partners, sub-contractors, and analytics providers, and may receive information about you from them.

We do not link aggregate user data with personal information. We reserve the right to disclose personal information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with any judicial proceeding, court order, or legal process served on us.

How We Use and Share Your Information

BFRANKLIN may use the Personal Information and other information it collects (unless otherwise restricted by law) to:

(1)          Personalize your experience and allow us to deliver the type of content and product offerings in which you are most interested;

(2)          Improve our Channels and related services in order to better serve you;

(3)          Allow us to better respond to your customer service requests;

(4)          Quickly process your transactions;

(5)          Ask for ratings and reviews of our Channels and related services; and

(6)          Respond to your correspondence.

We may share your Personal Information with companies that provide services on our behalf.  These companies have access to Personal Information needed to perform their functions, but may not use it for other purposes. BFRANKLIN does not share Personal Information about you with third parties for the third party’s own marketing purposes.

BFRANKLIN also may disclose Personal Information about you in order to:  (1) protect the legal rights, privacy or safety of BFRANKLIN or its employees, agents and contractors; (2) protect the safety and security of visitors to our websites or other properties; (3) protect against fraud or other illegal activity or for risk management purposes; (4) respond to inquiries or requests from government or public authorities; (5) pursue available remedies or limit the damages that we may sustain; or (6) comply with the law or legal process.

BFRANKLIN also may transfer any and all information that we collect about you to third parties in the event of any merger, sale, joint venture, assignment, transfer, bankruptcy, or other disposition of all or any portion of BFRANKLIN’s assets or stock (including without limitation in connection with any bankruptcy or similar proceedings).

Client Data

By registering for, accessing or using any BFRANKLIN products or services, you and/or the company from whom you are accessing or using any BFRANKLIN products and services (either directly or indirectly through a reseller), will become a BFRANKLIN “Client.” Clients may load data, including Personal Information, into BFRANKLIN systems (“Client Data”).  BFRANKLIN may access and process Client Data in the normal course of providing its products and services to Clients, including addressing technical issues, providing support services, or as otherwise may be required by the relevant agreement between the Client and BFRANKLIN.

Client Data is processed at the direction of Clients, and BFRANKLIN has no direct control or ownership of Client Data it processes.  Clients are responsible for complying with any regulations or laws that require providing notice, disclosure and/or obtaining consent prior to transferring the data to BFRANKLIN for processing purposes.

How We Protect Your Information

Your Personal Information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.

We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your Personal Information.

All transactions are processed through a gateway provider and are not stored or processed on our servers.

Retention and Deletion of Your Personal Information

BFRANKLIN will retain your Personal Information for as long as your account is active; as needed to provide you products or services; as needed for the purposes outlined in this Policy or at the time of collection; as necessary to comply with our legal obligations (e.g., to honor opt-outs), resolve disputes, and enforce our agreements; or to the extent permitted by law.

At the end of the retention period, BFRANKLIN will delete your Personal Information in a manner designed to ensure that it cannot be reconstructed or read.


Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. Our Channels are not intended for use by children and are not targeted to children.  BFRANKLIN does not knowingly collect personal information from children under 13, however, if you believe that your child under 13 has submitted information to us through interaction or use of any of our Channels without your permission, you may contact us at and we will delete the information as quickly as possible.

Changes to Our Privacy Policy

We reserve the right to amend this Policy at any time in order to address future developments of BFRANKLIN or changes in industry or legal trends.  We will post the revised Policy on our Internet site or announce the change on the home page of our Internet site.  You can determine when the Policy was revised by referring to the “Effective Date” on the top of this Policy.  Any changes will become effective upon the posting of the revised Policy on our Internet site.  

By continuing to use any of our Channels following such changes, you will be deemed to have agreed to such changes.  If you do not agree with the terms of this Policy, in whole or part, you can choose to not continue to use or interact with any Channel.

Confidentiality and Non-Disclosure Agreement

This Internet site (the “Site”) is owned and operated by Brightcore Residential, Inc., a Delaware corporation.  Brightcore Residential, Inc., which does business as BFranklin (referred to as “BFranklin”, “us”, “we”, or “our” as the context may require), operates and provides services through the Site.  Your use of the Site or any of the software subscription service offerings or other services offered on the Site, including any off-line or third party components, data, lists, projects, queries, reports, dashboards, clinical groupers or code groups, templates or services (collectively, the “Services”), is subject to this Confidentiality and Non-Disclosure Agreement (this “NDA”). BY REGISTERING FOR, ACCESSING OR USING ANY SERVICES ON THE SITE IN ANY MANNER WHATSOEVER, YOU INDICATE YOUR ACCEPTANCE OF THIS NDA AS A LEGALLY BINDING AGREEMENT. IF YOU DO NOT AGREE TO THIS NDA, OR ANY PROVISIONS CONTAINED HEREIN, DO NOT REGISTER FOR, ACCESS OR USE THE SERVICES PROVIDED ON THE SITE.  If you are agreeing to this NDA on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to this NDA. We may modify this NDA at any time without notice to you by posting a revised NDA on the Site. You are responsible for regularly reviewing this NDA. The term “Client” as used herein is the company from whom you are accessing or purchasing any Services, either directly or indirectly through a reseller.

This NDA is an integral part of our Terms of Service that apply to your purchase of any Services and to your access to our Services, including during any trial period.  Client should also carefully review our Privacy Policy (see above) before accessing or purchasing any Services through the Site.

Each party to this NDA (the “Receiving Party”) understands that the other party (the “Disclosing Party”) has disclosed or may disclose business, technical or financial information relating to the Disclosing Party’s business (hereinafter referred to as “Proprietary Information” of the Disclosing Party). 

Proprietary Information of BFranklin includes non-public information regarding features, functionality and performance of our Services. Without limiting the generality of the foregoing, you acknowledge that the Services, including the ideas, methods of operation, architecture, processes and know-how embodied in such items, constitute Proprietary Information of BFranklin or its licensors. BFranklin shall own and retain all right, title and interest in and to (i) the Services, all improvements, enhancements or modifications thereto, (ii) any software, applications, inventions or other technology developed in connection with any Services or support, and (iii) all intellectual property rights related to any of the foregoing.

Proprietary Information of Client includes non-public data provided by you to BFranklin to enable the provision of our Services, including any Personal Information (as defined in our Privacy Policy) and registration and other information you provide to us in connection with your access to our Services for evaluation purposes during any trial period (“Client Data”).  Client shall own all right, title and interest in and to the Client Data.

The Receiving Party agrees: (i) to take reasonable precautions to protect such Proprietary Information, and (ii) not to use (except in performance of the Services or as otherwise permitted herein) or divulge to any third person any such Proprietary Information.  The Disclosing Party agrees that the foregoing shall not apply with respect to any information after five (5) years following the disclosure thereof or any information that the Receiving Party can document (a) is or becomes generally available to the public, (b) was in its possession or known by it prior to receipt from the Disclosing Party, (c) was rightfully disclosed to it without restriction by a third party, (d) was independently developed without use of any Proprietary Information of the Disclosing Party or (e) is required to be disclosed by law. 

Notwithstanding anything to the contrary, BFranklin shall have the right collect and analyze data and other information relating to the provision, use and performance of various aspects of the Services and related systems and technologies (including, without limitation, information concerning Client Data and data derived therefrom), and BFranklin will be free (during and after the term hereof) to (i) use such information and data to improve and enhance the Services and for other development, diagnostic and corrective purposes in connection with the Services and other BFranklin offerings, and (ii) disclose such data solely in aggregate or other de-identified form in connection with our business.  No rights or licenses are granted except as expressly set forth herein.
